Neutral Citation No. - 2025:AHC:40655-DB Court No. - 29 Case :- WRIT - C No. - 4637 of 2025 Petitioner :- Mahendra Kumar Respondent :- State Level Committee / Chief Secretary And 3 Others Counsel for Petitioner :- Satish Kumar Mishra Counsel for Respondent :- C.S.C.,Pradeep Singh Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Heard learned counsel for the parties. This petition has been filed challenging a notice dated 31.07.2024, according to which the petitioner has unauthorizedly encroached upon various land. The petitioner contended that notice has been issued on false allegations and previous order passed by this Court in Writ-C No.9477 of 2023 Mahendra Kumar and 23 others Vs. Union of India and 3 others, on 22.04.2024 has not been complied with. Taking cognizance of such grievance, this Court proceeded to invite instructions from the concerned respondents. Instructions have been received by the State Counsel which is taken on record. Its copy has also been given to the learned counsel for the petitioner. Along with instructions, the respondents have placed on record an order passed by District Magistrate, Sonbhadra, dated 18.10.2024, according to which the petitioner owns land of various dimensions and that the very plea that the petitioner is landless labourer or forest dweller, is factually incorrect. The order passed by District Magistrate in his capacity as District Level Forest Committee is not under challenge. In such view of the matter, we are not inclined to entertain the present writ petition which is consequently consigned to records. The liberty stands reserved to the petitioner to challenge the order dated 18.10.2024 in appropriate proceedings.
