The present writ petition under Article 226 of the Constitution of India has been filed with the following prayers:- "i) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent nos. 2 & 3 to submit the progress report before this Hon'ble Court in connection with first information report dated 02-10-2024 being FIR no. 0172 of 2024 for the offences punishable under Sections 125(a), 125(b), 281 of B.N.S., 2023 at Police Station Mukhani, District Nainital. ii) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondent authorities to conduct the fair and transparent investigation of first information report dated 02-10-2024 being FIR no. 0172 of 2024 for the offences 2025:UHC:849 2 punishable under Sections 125(a), 125(b), 281 of B.N.S. 2023 at Police Station Mukhani, District Nainital as warranted under the law. iii) Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to conclude the Investigation keeping in mind the provision contained under Section 193 (1) of B.N.S.S., 2023 by taking appropriate steps against the accused persons. iv) Issue any other or further writ, order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the case. v) To award the cost of the petition in favour of the petitioner." 2. Heard Mr. D.N. Sharma, learned counsel for the petitioner and Mr. Pratiroop Pandey, learned AGA with Mr. Pradeep Lohani, learned Brief Holder for the respondent nos. 1 to 3. 3. Mr. Pratiroop Pandey, Advocate, on instruction, submitted that a charge-sheet has already been filed against the respondent no.5. 4. After the said submission, Mr. D.N.
