Islam, learned counsel for the petitioner, who has filed this writ petition with the following relief: “Under the above facts and circumstances, it is therefore prayed that your Lordships would graciously be pleased to admit this petition, issue notice to the respondent authorities, call for the records, issue rule, calling upon the respondents to show cause as to why a writ in the nature of Mandamus and / or any other appropriate writ, order or direction shall not be issued thereby directing the respondent authorities to issue Clearance Letter / Page No.# 3/3 Relieving Letter in favour of the petitioner and release the full and final settlements dues and / or cause or causes being shown if any and after perusal of the records and hearing the parties, your Lordships may be pleased to make the rule absolute as prayed for and / or pass such further Order / Orders as your Lordship’s may deem fit and proper for the interest of justice.” It however appears that the grievance is with regard to employee - employer relationship with the private respondents which cannot be construed to be “State” within the meaning of Article 12 of the Constitution of India. The cause of action would also not pertain to discharge of any public duty by private persons. At this stage, Shri Islam, learned counsel for the petitioner submits that he may be allowed to withdraw this writ petition so as to enable him to approach appropriate forum of law.
