It is submitted by the learned counsel for the petitioner that this civil miscellaneous petition has been filed at the instance of the petitioner for restoration of W.P. (C) No. 3558 of 2021 to its original file. It is next submitted by the learned counsel for the petitioner that W.P. (C) No. 3558 of 2021 was dismissed for non-compliance of peremptory order of depositing Rs.1,000/- with JHALSA. It is then submitted by the learned counsel for the petitioner that as the concerned counsel was out of station due to family function hence, the said peremptory order could not be complied with. It is next submitted that the petitioner has complied the said peremptory order of depositing Rs. 1,000/- with JHALSA. It is next submitted that the petitioner has very good grounds to agitate in the said W.P. (C) No. 3558 of 2021 and unless W.P. (C) No. 3558 of 2021 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that the W.P. (C) No. 3558 of 2021 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioner, W.P. (C) No. 3558 of 2021 is restored to its original file to the stage at which, it was before its dismissal.
