BEFORE HONOURABLE MR. JUSTICE SANJEEV KUMAR SHARMA ORDER 23.10.2025 Heard Mr. M.R. Khandakar, learned counsel for the petitioner and Mr. R.J. Baruah, learned Addl. P.P., Assam for the State respondent. 2. This bail application has been preferred for the second time by the petitioner namely, Abdul Mojid @ Abdul Mozid under Section 483 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, seeking bail in connection with Goalpara P.S. Case No. 156/2025 (G.R. Case No. 636/2025) under Sections 61(2)/143 of BNS, 2023, read with Sections 6/17 of POCSO Act read with Sections 3/4/5/7 of the Immoral Trafficking Act, 1956. 3. Mr. R.J. Baruah, learned Addl. P.P. submits that the Case diary is not received. 4. I have perused the earlier order passed by this Court dated 15.09.2025 in the previous bail application being Bail Appln. No.2935/2025, by which the prayer for bail in respect of the instant petitioner was rejected, as there was incriminating material available against the instant petitioner. 5. The present petitioner has passed 73 days in custody and the investigation of the case has also progressed. Considering the above as well as the nature of
Page No.# 3/3 the allegations, the prayer for bail is allowed. 6. Accordingly, the petitioner, named above, shall be released on bail on furnishing a bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount to the satisfaction of the learned Special Judge, Goalpara in connection with the aforementioned case.
The direction for bail is further subject to the conditions that the accused petitioner- (1) shall not leave the territorial jurisdiction of the learned Special Judge, Goalpara without prior written permission from him/ her. (2) shall not hamper with the investigation and tamper with the evidence of the case; and (3) shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. 7.
