Mandar, District- Ranchi (Jharkhand) .... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s). …… CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Amit Kr. Das, Advocate Mr. Vineet Sinha, Advocate For the State : Ms. Vandana Bharti, AddI. P.P. …...... 03/ 18.07.2025: Heard, learned counsel for the petitioner and learned counsel for the State. 2. This anticipatory bail application under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, has been preferred by the petitioner apprehending his arrest for offences under Sections 115(2), 126(2), 117(2), 109, 352, 351(2) and 3(5) of BNS. 3. Learned counsel for the petitioner submits that there is case and counter case and informant in both the cases are brother. He submits that petitioner’s father has also filed a case being Mandar P.S. Case No.53 of 2025 alleging assault upon him. He submits that the entire dispute arose in respect of property and paying money for the purpose of mutation, which was refused. He lastly submits that this petitioner has qualified for appointment in Central Government Armed Forces and only for this reason to stall his appointment, he has been implicated in this case. 4. The learned APP opposes the prayer for anticipatory bail and submits that admittedly there is a case and counter case between the parties and parties are directly related to each other. He submits that though in this case, the related witnesses have stated that both the brothers were fighting amongst themselves, but none of the independent witnesses had taken the name of this petitioner to be present. It is only the informant and his family members, who has taken the name of this petitioner. 5. Considering the fact that none of the independent witness has taken the name of the petitioner to be the assailants, I feel that this is a fit case for grant of anticipatory bail to the petitioner. 6. Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Ranchi, in connection with Mandar P.S. Case No.52 of 2025, subject to the condition that one of the bailers should be a close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his name or in the name of his ancestors in which he is having share and to that effect, he has to file an affidavit before the Trial Court indicating his share in the property. 7. The petitioner should cooperate and join investigation and appear before the Investigating Officer once in 15 days. (ANANDA SEN, J.) R.S./
