Heard learned counsel for the applicant, Sri Badrul Hasan, learned AGA for the State of U.P. and Sri Vineet Kumar Verma, Advocate holding brief of Sri Rajeev Narayan Pandey, learned counsel for the opposite party No. 2 as well as perused the record. 2. The instant application has been preferred seeking transfer of Criminal Case No. 305 of 2021 (Sushila Maurya vs. Satya Prakash Maurya) instituted in terms of Section 125 Cr.P.C. from the court of Additional Principal Judge, Family Court, Faizabad (Ayodhya) to the court of Principal Judge, Family Court, Ambedkar Nagar. 3. It appears from the record that at the time of institution of Criminal Case No. 305 of 2021 (Sushila Maurya vs. Satya Prakash Maurya) under Section 125 Cr.P.C., the applicant/Sushila Maurya was residing at District- Faizabad (now Ayodhya). 4. It also appears that after institution of aforesaid case, the applicant shifted to District- Ambedkar Nagar and she at present is residing at Village- Asharfabad Itrauna, Post Office- Rampur Sakarwari, Police Station- Bewana, District- Ambedkar Nagar and she also filed a case in terms of Section 12 D.V. Act before the competent court of jurisdiction at District- Ambedkar Nagar, which as per the instant application, is pending before the court of Civil Judge J.D. (Fast Track) 1st, Ambedkar Nagar as Versus Counsel for Applicant(s) : Anil Kumar Maurya, Rahul Kumar Sharma Counsel for Opposite Party(s) : G.A., Rajeev Narayan Pandey Sushila Maurya .....Applicant(s) State Of U.P. Thru Prin.Secy. Home Lko And Anr. .....Opposite Party(s) Case No. 1015 of 2022 (Sushila Maurya vs. Satya Prakash Maurya and others). 5. It further appears from the record that the opposite party No. 2/Satya Prakash Maurya (husband of the applicant) is also the resident of Village- Jainapur, Post Office- Paruiya Ashram, Police Station- Jalalpur, District- Ambedkar Nagar, who at present is residing at Vrindavan Colony 10- C/240 Telibagh, Kotwali P.G.I., Lucknow. 6. Taking note of the aforesaid and also the settled proposition of law on the subject, the instant application seeking transfer is hereby allowed. 7. Criminal Case No. 305 of 2021 (Sushila Maurya vs. Satya Prakash Maurya) instituted by the applicant in terms of Section 125 Cr.P.C. is hereby transferred from the court Additional Principal Judge, Family Court, Faizabad (Ayodhya) to the appropriate/competent court at District- Ambedkar Nagar.
