Heard Mr. K. Thakur, learned counsel appearing for the petitioner. Also heard Mr. R. Kaushik, learned Addl. Public Prosecutor appearing for the State. Page No.# 2/3 By this application, the petitioner has prayed for pre arrest bail in connection with P.R.C Case No. 295/2025 corresponding to G.R. Case No. 567/2024 registered under Section 61(2)/318(4)/316(2)/178/179/180 of BNS, 2023 arising out of Bihpuria P.S. Case No. 120/2024. The FIR dated 04.08.2024 reveals that on the secret information, the police conduct a search operation in the house of one Nekib Uddin and during the said search, number of fake currency notes were recovered and further on interrogation of the said Nekib Uddin, it was found out that there was other persons who are involved in the said offence. During investigation, the police found out the other accused persons and the petitioner was one of them and on completion of the investigation, the police submitted the charge sheet arraying the petitioner as one of the accused persons. Mr. K. Thakur, learned counsel appearing for the petitioner submits that pursuant to the filing of the charge sheet, summon was issued to the petitioner and that since the instant case is sessions triable case the petitioner apprehends arrest. Mr. R. Kaushik, learned Addl. Public Prosecutor however submits that only summons were issued to the petitioner and that there was no apprehension on the part of the petitioner of being arrested. Upon consideration of the submissions made by the counsels and on
Page No.# 3/3 contents of the charge sheet, this Court finds it fit that the petitioner may be released on pre arrest bail on furnishing of a bail bond of Rs. 20,000/-(Rupees twenty thousand) with one (1) local surety of the like amount to the satisfaction of Trial Court under the following conditions:- 1) The petitioner shall cooperate with the investigation and shall appear before the Trial Court as and when called for.
2) The petitioner shall not tamper with the evidence or influence any of the witnesses. 3) The petitioner shall not leave the jurisdiction of the Trial Court without prior permission of the said Court. 4) The petitioner shall appear before the Trial Court within fifteen (15) days from the date of order and would positively appear before the Trial Court on 22.10.2025. The petition is disposed of. JUDGE Comparing Assistant
