Principal Secretary, Panchayati Raj Department, Rajasthan, Jaipur. 4. District Collector, Alwar. ----Respondents For Petitioner(s) : Mr. Anil Jain For Respondent(s) : HON'BLE MR. JUSTICE INDERJEET SINGH HON'BLE MR. JUSTICE ANAND SHARMA Order 27/05/2025 This Public Interest Litigation has been filed by the petitioner with the following prayers:- “(i) issue an appropriate writ, order or direction in the nature thereof thereby; direct the respondents to include the name of village Kanwada in the newly formed fourth Class Municipality, Laxmangarh, District Alwar. (ii) Any other appropriate order or direction which this Hon’ble Court deems fit and proper in favour of the petitioner may kindly be passed. (iii) Cost of the writ petition may kindly be provided to the petitioner.” [2025:RJ-JP:22186-DB] (2 of 2) [CW-8338/2020] We have perused the prayer made by the petitioner in this writ petition. The petitioner prayed for inclusion of the Village Kanwada in formation of New Fourth Class Municipal Board, Laxmangargh, District Alwar. We have perused the notification dated 19.06.2020 issued by the State Government with regard to constitution of New Municipal Council. In our considered view, inclusion and exclusion of villages in a particular municipality is within the sole domain of the State Government. The villagers have no right to claim for inclusion in a particular municipal council. In that view of the matter, no case is made out for interference by this Court. Hence, this Public Interest Litigation stands dismissed. (ANAND SHARMA),J (INDERJEET SINGH),J JYOTI /48
