HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL REVISION No. - 1351 of 2025 Court No. - 13 HON'BLE SAURABH LAVANIA, J. Heard learned counsel for the revisionist, learned A.G.A. for the State and perused the record. This criminal revision under Section 397/401 Cr.P.C. read with Section 442 of the BNSS has been filed seeking following main relief (s) :- "(i)Quash and set aside the impugned order, dated 01/09/2025, passed by the learned Additional District and Session Judge Court No.10, Lucknow in Case No. 144/23 (State vs. Waseeq Siddiqui) dismissing the discharge application by the Revisionist. (ii) Pass appropriate order discharging Revisionist arising out of case crime the по.144/23, under section -307, 323, 352, 354 (b), 504 of I.P.C., P.S Thakurganj, District Lucknow." The perusal of the records indicates that the revisionist has not brought on record the relevant documents viz., the application filed before the Session Court seeking discharge in terms of Section 227 Cr.P.C., copy of charge sheet and other relevant documents which were provided to the revisionist in terms of Section 207 Cr.P.C. On being confronted, after taking note of the above, learned counsel for the Versus Counsel for Revisionist(s) : Awdhesh Kumar Mishra, Anit A Dwivedi, Mahraz, Meenakshi Shree Tiwari Counsel for Opposite Party(s) : G.A. Waseeq Siddiqui .....Revisionist(s) State Of U.P. Thru. Prin. Secy. Home Lko. And Another .....Opposite Party(s) revisionist states that he may be permitted to withdraw the revision with liberty to file afresh with proper pleadings and documents in support thereof. Accordingly, the writ petition is dismissed as withdrawn with the liberty as prayed for.
