HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 405 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. According to the prosecution, the applicant is alleged to have prepared forged and fabricated transfer orders pertaining to three constables, namely, Hari Narayan Mishra, Sanjay Kumar, and Vijay Bahadur Yadav, and further, to have dispatched the same after verifying them as genuine. Submission of learned counsel for the applicant is that a Coordinate Bench of this Court has passed an interim order, staying further proceedings pursuant to the charge sheet dated 29.05.2025 in respect of the applicant, vide order dated 14.06.2024 in Writ-A No. 4718 of 2024, which remains pending consideration. It is further contended that the applicant is in custody since 09.12.2024 and has no criminal antecedents. It is further argued that the applicant’s signatures have not been referred for FSL examination and the officer whose signatures are allegedly forged has not been made as a prosecution witness in the charge sheet. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned AGA, on the other hand, has opposed the bail application and has drawn attention to the statements of prosecution witnesses placed on record Versus Counsel for Applicant(s) : Sooraj Lal, Prahlad Singh, Ravi Singh Counsel for Opposite Party(s) : G.A. Vinod Kumar Singh .....Applicant(s) State Of U.P. Thru. Its Prin. Secy. Home Lko .....Opposite Party(s)
through the counter-affidavit. It is submitted that the signatures of Shri Piyush Mordiya, Additional Director General, Banaras Zone, were compared with the signatures purportedly forged by the applicant; however, he does not dispute the fact that the aforesaid officer has indeed not been arrayed as a prosecution witness. Upon consideration to the facts that the offences alleged are triable by the Magistrate, the charge sheet has already been filed, and the applicant is in jail since 09.12.2024 with no criminal antecedents, this Court is of the view that a case for grant of bail is made out. Accordingly, the bail application is allowed.
Let the applicant Vinod Kumar Singh, involved in FIR No. 0012/2024, dated 16.02.2024, U/S-477-A, 467, 468, and 471 IPC Police Station Gautampalli, Lucknow, District Lucknow, be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial Court. Any other condition(s) which the trial court/concerned court may deem fit and proper, in the circumstances of the case, may also be imposed. It is clarified that the observations made in this order are confined to the present bail application and shall have no bearing on the merits of the trial. December 8, 2025 R.C.
