AMARNATH GOUD Order 25.09.2025 This is a petition under Article 226 of the Constitution of India for seeking the following relief(s): Issue Rule upon the Respondents to show cause as to why a Writ in the nature of Mandamus and/or any other order/orders shall not be issued whereby directing the Respondents to grant the benefit of one advance increment in favour of the Petitioners for undergoing training in Certificate in Elementary Education (CETE), and also grant all ancillary benefits flowing therefrom, including but not limited to re-fixation of the pay of the Petitioners. AND Call for the records pertaining to the instant Writ Petition from the custody of the Respondents and to make the rule absolute. AND After hearing both the parties pass order/orders as this Hon'ble High Court considers to be fit and proper. It is seen from the record that there is no impugned order under challenge. Hence, the writ petition is not maintainable under Article 226 of the Constitution of India, where a writ of mandamus can be issued. On this ground, the instant writ petition stands dismissed. However, during the course of hearing, learned counsel for the petitioners submitted that since the matter relates to the retirement benefits of employees, some direction may be issued for consideration of the petitioners’ case. The petitioners are at liberty to approach the respondents, if so advised, by submitting proper documentation. On receipt of the same, it shall be open to the respondents to consider the petitioners’ claim in accordance with law.
