HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 12500 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant, learned AGA for the State and perused the record. Learned counsel for the applicant submits that the co-accused, Sushil Kumar, who is alleged to have appeared in the examination in place of the applicant, has been granted bail vide order dated 05.02.2024 passed in Criminal Misc. Bail Application No. 1282 of 2024. It is argued that case of the applicant is on a better footing than the co-accused who has already been granted bail. The applicant is in custody since 18.10.2025 and has no criminal antecedents. It is further submitted that the applicant has been falsely implicated and has not committed any offence. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses. In case the applicant is enlarged on bail, he shall not misuse the liberty of bail. Learned A.G.A. opposed the prayer for bail but could not dispute the aforesaid facts as argued by the learned counsel for the applicant. Upon due consideration to the fact that the co-accused Sushil Kumar has been granted bail, the charge-sheet has been filed, and the applicant is in custody since 18.10.2025 without any criminal history, I am of the view that a case for granting bail to the applicant is made out.
