Heard learned counsel for the applicant, learned AGA and perused the record. 2. The applicant seeks enlargement on bail in FIR No.77 of 2022, under Section 304 IPC, P.S. Ibrahimpur, District Ambedkar Nagar. 3. Vide order dated 23.09.2024 passed by this Court, directions were issued for recording of the testimony of the sole eyewitness Ramjas. 4. Learned counsel for the applicant states that subsequently, the testimony of the informant as well as sole eyewitness Ramjas has been recorded wherein the eyewitness has not supported the prosecution; even the informant has not supported the prosecution. 5. Learned AGA has opposed the bail application. 6. Considering the aforesaid, the applicant who is in custody since 30.04.2022 and has no criminal antecedents, is entitled to be enlarged on bail. In view thereof, the application is allowed. 7. Let the applicant Achchhey Lal Gautam be released on bail in aforesaid FIR number on his furnishing a personal bond with two sureties of Rs.20,000/- each to the satisfaction of court concerned with the following conditions: Versus Counsel for Applicant(s) : Firoz Ahmad Khan, Saryu Prasad Tiwari Counsel for Opposite Party(s) : G.A.
