HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 9321 of 2025 Court No. - 13 HON'BLE SUBHASH VIDYARTHI, J.
1. Heard Sri Syed Asaghar Mehdi, the learned counsel for the applicant, Sri Satyendra Srivastava, the learned A.G.A. for the State and perused the record. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No.126 of 2024, under Sections 406, 419, 420, 467, 468, 471, 506 I.P.C., registered at Police Station Wazirganj, District Lucknow. 3. The aforesaid case has been registered on the basis of an F.I.R. lodged on 15.04.2024 against three persons, including the applicant, stating that the complainant wanted to purchase a plot of land. The other accused persons introduced him to the applicant, who sold his land to the complainant through a sale deed dated 11.12.2023, for a sale consideration of Rs. 72 Lakhs. Before execution of the sale deed, the complainant had given Rs. 25 Lakhs in cash to the applicant, which amount was later on returned by the applicant to the complainant. The complainant had paid the sale consideration after examining the relevant records and after obtaining a loan from a bank. 4. Subsequently, it transpired that the land was disputed and no sale deed in respect of the land had been executed by the Versus Counsel for Applicant(s) : Syed Asaghar Mehdi Counsel for Opposite Party(s) : G.A. Rajneesh Trivedi .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. .....Opposite Party(s)
Lucknow Development Authority. 5. The F.I.R states that initially, the accused persons had assured to refund the money of the complainant but later on they did not fulfill the assurance. The complainant has requested in the F.I.R that his money be returned to him. 6. In the affidavit filed in support of the bail application, it has been stated that the applicant is an innocent person, he has been falsely implicated in the present case and he has no criminal history. 7. The learned A.G.A. has opposed the bail application and he has submitted that the investigation in the matter is still going on. 8. Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that even as per the F.I.R version, the complainant had paid Rs.
25 lakh in cash to the applicant before the execution of the sale deed, which money has been returned by the applicant to the complainant, the complainant had agreed to purchase the land after making requisite inquiries and after taking loan from a bank and the bank grants loan after necessary verification; the complainant had requested through the F.I.R that his money be returned to him, which relief essentially gives rise to a civil dispute and that the applicant has no previous criminal history and he is languishing in jail since 21.07.2025, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail. 9. Accordingly, this bail application stands allowed. 10. Let the applicant- Rajneesh Trivedi be released on bail in aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to the following conditions: - (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses;
