HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 11908 of 2025 Court No. - 7 HON'BLE MANISH MATHUR, J. (1) Heard learned counsel for petitioner and Mr. Vikas Singh, learned State Counsel for opposite parties. (2) Petition has been filed seeking a direction to authority concerned to regularize services of petitioner in accordance with Uttar Pradesh Regularization of Daily Wages Appointment on Group 'D' Posts Rules, 2001 [in brief, it is stated as 'Rules, 2001']. Further prayer for granting seniority from 1986 as well as for payment of arrears of salary etc., has also been sought. (3) Learned State Counsel submits that earlier petitioner had filed Writ-A No. 11358 of 2017 which was allowed by means of judgment and order dated 15.05.2024 with a specific direction for consideration of petitioner's case for regularization in accordance with the Uttar Pradesh Regularisation of Persons Working on Daily Wages or On Work Charge or On Contract in Government Departments on Group "C" and Group "D" Posts (Outside the Purview of the Uttar Pradesh Public Service Commission) Rules, 2016 [here-in-after referred to as 'Regularization Rules, 2016' for the sake of brevity] which has been complied with by passing order dated 07.09.2024 and therefore relief as sought for cannot be granted to petitioner. (4) Learned counsel for petitioner does not dispute aforesaid aspect and submits that he may be granted liberty to seek modification/recall of the Versus Counsel for Petitioner(s) : Mahendra Pratap Verma Counsel for Respondent(s) : C.S.C. Santram Verma .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Forest Deptt. Lko. And 4 Others .....Respondent(s) order dated 15.05.2024 passed in Writ-A No. 11358 of 2017. (5) Upon consideration of submissions advanced by learned counsel for parties and perusal of material on record, it is evident that by means of judgment and order dated 15.05.2024 passed by a Co-ordinate Bench of this Court in Writ-A No. 11358 of 2017, a direction had been issued for consideration of petitioner's case for regularization in accordance with Regularization Rules, 2016. In pursuance thereof, an order has been passed on 07.09.2024 granting such regularization to petitioner. (6) In the considered opinion of this Court, once a specific direction has been issued by a Co-ordinate Bench of this Court for consideration of petitioner's case for regularization in accordance with Regularization Rules, 2016, it would beyond jurisdiction for this Court to grant relief as sought for regularization in accordance with Rules, 2001. The same may be permissible in case the judgment and order dated 15.05.2024 passed in Writ-A No. 11358 of 2017 is modified by the Court concerned. (7) In view of aforesaid, this Court does not find any good ground to grant indulgence. It shall be open to the petitioner to seek appropriate relief in Writ-A No. 11358 of 2017. (8) Petition therefore is dismissed at the admission stage itself. Parties to bear their own costs. October 15, 2025 lakshman WRIA No. 11908 of 2025 2 (Manish Mathur,J.)
