G VENKATA REDDY The Court made the following: 3 THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI WRIT PETITION No.12624 OF 2019 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: “….to issue a Writ, Order or Direction, more particularly one in the nature of a Writ of MANDAMUS, declaring the action of the Respondents 6 and 7 herein in not registering crime basing upon the written Complainant given by the Petitioner herein dated 27.06.2019, as illegal, arbitrary and contrary to the decision rendered by the Hon'ble Supreme Court of India in Lalita Kumari Vs. Government of Uttar Pradesh (i.e. reported in 2014 (2) SCC page 1 and consequently direct the Respondents 6 and 7 herein to register and investigate into the written Complaint made by the Petitioner herein, forthwith and pass…” 2. None appeared for the petitioner. 3. Learned Assistant Government Pleader for Home on written instructions would submit that basing on the report of the petitioner, police registered a case in Crime No.129 of 2019 of Thallur Police Station, for the offence under Sections 420, 385 of IPC and investigated into the case and later, filed final report, referred the case as civil in nature vide C.No.395/Ref-SDOD/2019 of SDPO, Darsi, dated 30.12.2019 and therefore, the writ petition has become infructuous. 4. The writ petition was filed alleging that police did not register a case basing on the report of the petitioner presented on 27.06.2019. Now, the instructions of learned Assistant Government Pleader would disclose that police registered a case and investigated into the same and also referred the same. Hence, the petitioner has to approach 4 the jurisdictional Magistrate for necessary redressal in accordance with law. 5. In that view of the matter, the writ petition has become infructuous. 6. Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
