Mosum Yadav W/o Late Vikash Yadav D/o Late Shri Kanaram Yadav, Aged About 30 Years, R/o Daluka Ki Dhani, Village Dhoblai Police Station Govindgradh, District Jaipur Presently Pihar Aamwali Dhani Village Nangal Koju Police Station Govindgradh, District Jaipur. ----Petitioner Versus The State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Anish Bhadala For Respondent(s) For Complainant : : Mr. Naresh Kumar Gupta, PP Mr. Rinesh Gupta HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 31/07/2025 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.212/2025 registered at Police Station- Chomu, District-Jaipur (West) for offences under Sections 108 and 61(2)(b) of BNS. 2. Heard learned counsel for the petitioner, learned Public Prosecutor and counsel for the complainant and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that the, the incident relates to 19.02.2025 wherein the FIR has been lodged after a delay of more than a month, on 24.03.2025. From the perusal of the inquiry conducted by the Executive Magistrate [2025:RJ-JP:29100] (2 of 2) [CRLMB-6739/2025] under Section 194 of BNSS, it is clear that the deceased himself has committed suicide. In fact though there was some small routine family dispute between the petitioner and deceased but that was not serious in nature, which could lead to suicide. As per the CCTV footage too, the conduct of petitioner and deceased appears to be normal in nature. Petitioner has not abetted the alleged offence. She is 30 years lady who is behind the bars since 12.05.2025. Charge-sheet has been filed. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, hence the bail application of the petitioner may be allowed. 4. Learned Public Prosecutor and counsel for the complainant have vehemently opposed the bail application. 5. On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioner-Smt. Mosum Yadav W/o Late Vikash Yadav D/o Late Shri Kanaram Yadav shall be released on bail on her furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for her appearance before that Court on all the dates till conclusion of the trial.
