Heard Ms. S.K. Nargis, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State and Mr. S. Choudhury, learned counsel appearing for the father of the alleged victim.
2. The accused is stated to be in jail since 30.04.2025 in connection with Sessions (Spl.) Case No.98/2025 under Section 376 IPC, R/W Section 6 of POCSO Act, arising out of Paltanbazar P.S Case No.546/2023 2025 under Section 376 IPC, R/W Section 4 of POCSO Act, 2012.
3. The scanned TCR was called for but the same is not yet received.
4. However, I have perused the copies of the charge-sheet and deposition of the victim with the petition. In the deposition, the victim girl stated about her long standing relationship with the accused, who’s her neighbour. Pursuant to which they have relationship leading to her pregnancy.
5. It is also stated by her that the marriage has been fixed between them and that even now she has been visiting the accused in jail.
6. The learned counsel for the informant submits that he does not object to the grant of bail to the petitioner.
7. Upon perusing the materials, I am satisfied that the matter can be disposed of granting bail to the accused/petitioner.
8. Accordingly, it is directed that the accused/petitioner herein is allowed to
Page No.# 3/3 go on bail of Rs. 30,000/- with one surety of like amount to the satisfaction of the concerned learned Court and subject to the following conditions that:- (i) That the accused shall co-operate with the process of law.
9. The bail petition stand allowed and disposed of.
