For Petitioner(s): Mr.M.R.Jothimanian For Respondent: Mr.Abishek Murthy Government Advocate for R1 & R2 ORDER This writ petition has been filed by the petitioner seeking to direct the 2 nd respondent to consider the objection made by the petitioner dated 09.01.2025 and 13.11.2025 with regard to his property comprised in S.No.558/1B1B to an extent of 18 cents in patta No.8055, situated at Sunjalnatham Village, Pennagaram Taluk, Dharmapuri District. 2.Mr.Abishek Murthy, learned Government Advocate takes notice on https://www.mhc.tn.gov.in/judis WP No. 45569 of 2025 behalf of the respondents 1 & 2. By consent of both parties, this writ petition is taken up for final hearing at the admission stage itself. 3.Learned counsel for the petitioner would submit that the 3 rd respondent intends to present the sale deed in respect of the property comprised in S.No.558/1B1B to an extent of 18 cents in patta No.8055, situated at Sunjalnatham Village, Pennagaram Taluk, Dharmapuri District, without any right over the said property. In this regard, the petitioner has given objections before the 2 nd respondent through representations dated 09.01.2025 and 13.11.2025. However, the same have not been considered by the respondents, till date. Hence, the present writ petition has been filed. 4.Learned Government Advocate appearing for the respondents would submit that the objections raised by the petitioner for registration of sale deed pertaining to the subject property will be considered if any sale deed is presented for registration by the 3 rd respondent. So far no sale deed has been presented by the 3 rd respondent and therefore, since no cause of action has arise, https://www.mhc.tn.gov.in/judis WP No. 45569 of 2025 the objection of the petitioner is kept pending. In the event, the 3 rd respondent presented any sale deed regarding the subject property, the 2 nd respondent will issue notice to the petitioner and other parties concerned and a decision will be taken by the 2 nd respondent regarding the registration of subject property. 5.Heard the learned counsel for the petitioner as well as the learned Government Advocate appearing for the respondents 1 and 2 and perused the materials available on record. 6.Considering the submissions made by either parties and in view of the limited prayer sought for in this writ petition, without going into the merits of the case, this Court directs the 2 nd respondent to consider the representations of the petitioner dated 09.01.2025 and 13.11.2025, after issuing notice to the petitioner and other parties concerned, in the event the 3 rd respondent presented any documents for registration in respect of the subject property and dispose of the same on merits and in accordance with law. https://www.mhc.tn.gov.in/judis WP No. 45569 of 2025 7.With the above direction, this Writ Petition is disposed of.
