This present application has been filed under for a direction to release the part payment of compensation in terms of the judgment and order dated 04.08.2025 in MAC App.8 of 2025 passed by this Court. The reliefs sought for by the applicants in the present application, are as under: “…..7. That, the rest shall be submitted at the time of hearing. Under the circumstances stated here in above it is most humbly prayed to your lordship to direct the release of Rs.5,00,000/- (Rupees five lakhs) only together with interest @ of 6% per annum from the date of filing of the claim petition from 11.11.2021 till payment to the petitioner no.1 and the balance of the amount may be invested as per direction given in the award in respect of petitioner no.1, 2 & 3……..” In view of the averments made in the accompanying affidavit and upon hearing the submissions made at the Bar, this Court is inclined to consider the request of the counsel for the applicant(s) giving entitlement to the applicant(s)/claimant(s) for withdrawal of the deposited amount in part as per procedure.
