Sundari, learned G.A. for the State respondent and Mr. Kh. Tomba, learned counsel for the applicant in MC(WP(C) No. 673 of 2024. Also present Mr. Mayonkui Ngalung, learned counsel for the ADC. [2] The present application has been filed by the petitioner Nos. 133, 144, 151, 154, 100, 146, 129, 120, 131, 155, 154, 104, 2024, 119, 107, 105, 106, 118, 208, 103, 93, 128, 147, 148, 177, 149, 176, 178, 150, 159, 162, 219, 102, 132, 21, 1609, 143, 122, 124, 136, 158, 142, 137, 140 & 139 on the plea that their names have been deleted by the order dated 12.06.2023 passed by this Court and they have not made any prayer for deletion of their names from MC(WP(C) No. 167 of 2023 and prayed that the order be recorded. However, on perusal of the application, the same is filed by the counsel of the above named petitioners. [3] This Court is of the view that the applicants should file the application under their own signatures and affidavit and not through the counsel as the counsel is not supposed to file such application. [4] Mr. Kh. Tomba, learned counsel for the applicant, submits that he may be permitted to withdraw the present application with liberty to file a fresh one in terms of law. [5] Learned G.A. and Mr. DP. Sahu, learned counsel for the petitioner, have no objection. [6] Recording the submissions made at the bar, MC(WP(C) No. 673 of 2024 is dismissed as withdrawn with liberty to file a fresh one, if so advised. [7] List the remaining matter on 10.02.2025.
