Chaudhary, Police Inspector, LCB-1, Gandhinagar states that the statement is already recorded and he has submitted the report however, now for the purpose of investigation report is already submitted to the concerned authority. Hence, at this stage, as presence of the petitioner is not required. If in future any offence is registered then the petitioner shall have to take appropriate recourse. In view of above statement made by the learned APP, prayer clause ‘B’ and ‘C’ are already satisfied and at this stage, learned advocate for the petitioner does not press prayer clause ‘D’ and hence, petition qua prayer clause ‘D’ stands disposed of as not pressed. However, if in future, any offence is registered, it is always open for the petitioner to file appropriate proceedings including anticipatory bail application or regular bail application, if so advised.
