PUBLIC PROSECUTOR The Court made the following: ORDER: Criminal Petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita Act, 2023 (for brevity ‘the BNSS’) by the 2 Petitioner/Accused No.21, seeking to quash the proceedings against him in Cr.No.79 of 2022 dated 29.04.2022 on the file of Duggirala Police Station, Guntur District for the alleged offences punishable under Sections 143, 323 and 506 read with 149 of the Indian Penal Code, 1860 (for brevity, ‘the I.P.C.,’) and Sections 3(1)(r),3(1)(s) and 3(2)(va) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for brevity, ‘the SC/ST (POA) Act’). 2. I.A.No.3 of 2025 has been filed by the Petitioner/de‑facto complainant/Respondent No.2 seeking permission to compromise the case in Cr.No.79 of 2022 dated 29.04.2022 on the file of Duggirala Police Station, Guntur District, against the Petitioner/Accused No.21. 3. I.A.No.4 of 2025 has been filed by the Petitioner/de‑facto complainant/Respondent No.2 seeking to record the compromise between the Petitioner/de‑facto complain ant and the Respondent/Accused No.21 as per the joint memo, and to quash the proceedings in Cr.No.79 of 2022 dated 29.04.2022 on the file of Duggirala Police Station, Guntur District. 4. Mr.A.Sai Rohith, learned Assistant Public Prosecutor for the State, reported no objection to record the compromise. 5. As per joint memo filed by both parties, it is submitted that Crl.P.No.7598 of 2025 seeks to quash FIR No.79 of 2022 dated 29.04.2022 registered at Duggirala Police Station, Guntur District, for the alleged offences punishable under Sections 143, 323, 506 read with 149 of ‘the I.P.C.,’ against 3 the Accused No.21, whose name was mentioned on a mistaken premise though his presence was only coincidental. The de-facto complainant and Accused No.21 belong to the same community, maintain cordial relations, and have voluntarily entered into compromise without coercion or undue influence. The de-facto complainant has agreed to withdraw the case and is not interested in pursuing the FIR against Accused No.21, while clarifying that this compromise will not affect the pending investigation or proceedings against other accused. 6. Considering the submissions and in the light of the judgment of the Hon’ble Apex Court in Gian Singh vs. State of Punjab and another1, since there is an amicable settlement between the parties, in the interest of justice, I.A.Nos.3 and 4 of 2025 are disposed of. 7. Consequently, Criminal Petition is allowed, and the case against the Petitioner/Accused No.21 in Cr.No.79 of 2022 dated 29.04.2022 on the file of Duggirala Police Station, Guntur District for the alleged offences punishable under Sections 143, 323 and 506 read with 149 of ‘the I.P.C.,’ and Sections 3(1)(r),3(1)(s) and 3(2)(va) of ‘the SC/ST (POA) Act’ is hereby quashed.
