Heard learned counsel for the petitioner and learned Standing Counsel Ms. Akahnksha Dubey. This petition has been filed with the following prayers :- "issue a writ of mandamus or any other appropriate writ, order or direction directing the opposite parties no.2, 3 and 4 to expeditiously consider and decide, within a stipulated time frame as may be fixed by this Hon'ble Court, the representation/ complaint dated 08.8.2025 submitted by the petitioner in relation to false and incorrect entries in the electoral roll of Gram Panchayat Assembly Constituency of Ganeshpur Newada, pargana & Tehsil Laharpur, District Sitapur." In view of the order proposed to be passed issuance of notice to the respondents no.5 and 6 is dispensed with. It is the case of the petitioner that the name of respondents no.5 and 6 has been shown in the electoral roll of Gram Panchayat Assembly Constituency of Ganeshpur Newada, pargana and Tehsil Laharpur, District Sitapur incorrectly as they do not live in ward no.13 in village Ganeshpur Newada as indicated in the electoral roll, a copy of which has been filed as Annexure no.1 to the petition. The petitioner has given representation to respondent no.2 Chief Electoral Officer, U.P., Lucknow Versus Counsel for Petitioner(s) : Gaurav Verma Counsel for Respondent(s) : C.S.C. Mohammad Waseem .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Home Sectt. Lko. And 5 Others .....Respondent(s) on 08.8.2025 and prays that the same be directed to be decided expeditiously. Ms. Akanksha Dubey, learned Standing Counsel on the other hand has referred to the U.P. Panchayat Raj (Registration of Electors Rules), 1994 wherein there is specific procedure prescribed for a claim for inclusion of name in the territorial constituency of Gram Panchayat and also for objections to entries in the said roll under Rule 9 and 10. It has been submitted that revision of electoral roll is going on and draft list of electors has not yet been published. As and when such draft list is published the petitioner will have opportunity to file his objections under Rule 10 of the said Rules of 1994. Present writ petition is disposed of with the liberty to the petitioner to approach the appropriate authority at the appropriate time.
