The petitioners, who are being prosecuted for offences punishable under Sections 498A, 504, 506, and 34 of the Indian Penal Code, have approached this Court seeking appropriate relief. 2. The prosecution alleges that accused No.1– the husband, and accused No.2– the mother-in-law, subjected - 3 - NC: 2025:KHC:14705 CRL.P No. 3621 of 2025 the defacto complainant to mental and physical cruelty, and also threatened her with dire consequences. 3. The parties are present before this Court and have filed a Joint Affidavit stating that they have amicably resolved the dispute through mediation. As per the terms of the settlement, the marriage between accused No.1 and the defacto complainant has been dissolved by mutual consent in M.C. No.263/2023. Respondent No.2 – the defacto complainant, has agreed to withdraw all allegations against the petitioners and has no objection to quashing the impugned proceedings. 4. The Joint Affidavit is taken on record. 5. Although the offences alleged against the petitioners are cognizable and non-compoundable, considering the fact that the parties have amicably settled the dispute, subjecting the petitioners to trial would serve no useful purpose. The likelihood of conviction, in view of the settlement, is remote and bleak. In such circumstances, the continuation of criminal proceedings would amount to an abuse of the process of law. 6. Accordingly, I pass the following: - 4 - NC: 2025:KHC:14705 CRL.P No. 3621 of 2025 ORDER i) The Criminal Petition is allowed; ii) The impugned proceedings in C.C.No.8450/2023 registered by respondent No.1 - Kadugodi Police on the file of the I Additional Chief Judicial Magistrate, Bengaluru Rural District at Bengaluru. iii) I.A.No.1/2025 does not survive for consideration and is hereby rejected.
