JUSTICE KAUSHIK GOSWAMI ORDER Date : 15.09.2025 Heard Mr. M. Z. Ahmed, learned senior counsel assisted by Mr. A. M. Dutta, learned counsel appearing for the petitioners. Also heard Mr. R. Dhar, learned counsel appearing for the sole respondent. 2. By way of this review petition, the petitioners are seeking review/modification/clarification of the operating part of the judgment dated 19.02.2018, passed by this court in WP(C) No. 883/2017. 3. Mr. M. Z. Ahmed, learned senior counsel appearing for the petitioners, submits that in the operating part of the judgment under review in paragraph No. 7, an apparent error crept into the judgment to the effect that the respondents are directed to consider the case of the petitioner for dependent employment/compassionate appointment, as against the next immediate vacancy that arises in the future instead of in terms of Clauses 9.3.0, 9.4.0 and 9.50 of Chapter IX of the National Coal Wage Agreement of Coal India Limited. 4. Mr. M. Z. Ahmed, learned senior counsel appearing for the Page No.# 3/3 petitioners, submits that he has no objection if, to that extent only, the order is reviewed. 5. Having heard the learned counsel appearing for the petitioners and noticing that inadvertently an error has crept into the order of this court dated 19.02.2018, the judgment and order of this court dated 19.02.2018 is corrected by providing that instead of “the respondents are directed to consider the case of the petitioner for dependent employment/compassionate appointment, as against the next immediate vacancy that arises in the future” in paragraph 7 of the said judgment, it shall read as “The respondents are directed to consider the case of the petitioner for dependent employment/compassionate employment in accordance with clauses 9.3.2 of Chapter IX of National Coal Wage Agreement”. 6. Corrected accordingly. 7. This order shall form a part of the judgment dated 19.02.2018. 8. With the above observation and direction, this review petition stands closed. JUDGE Comparing Assistant
