Heard Sri Vinay Prakash Katiyar, the learned counsel for the petitioner, Sri Devendra Mohan Shukla, the learned Additional Chief Standing Counsel for the State of U.P.. 2. Keeping in view the order proposed to be passed, issuance of notice to the opposite party no. 4 is dispensed with. 3. By means of the present writ petition, the petitioner has sought issuance of a direction for execution of demolition order dated 22.02.2023 passed against the opposite party no. 4. The opposite party no. 4 has filed an appeal under Section 15(2) of Uttar Pradesh (Regulation of Building Operations) Act, 1958 before the District Magistrate/ Controller Authority, Sitapur, which is pending consideration. 4. Demolition of construction during pendency of the appeal would not be expedient in the interest of justice but the expeditious disposal of appeal is essential to secure the ends of justice. 5. Accordingly, the writ petition is disposed of by directing the opposite party no. 2-District Magistrate/ Controller Authority, Sitapur to decide Appeal No. 736/2023, under Section 15(2) of Uttar Pradesh (Regulation of Building Operations) Act, 1958 titled Rajesh Kumar v.
