HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 12543 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant and learned A.G.A. for the State as well as perused the record. The accused-applicant seeks bail in Case Crime No.259 of 2024 under Section 191(2)/352/351(3)/109 BNS, Police Station Wazirganj, District Lucknow. According to the prosecution case, while the complainant was present on the 7th floor of the Civil Court building at about 3:45 p.m. in connection with his pending case, the named accused along with 15–20 unknown persons, some dressed in lawyers’ uniform, arrived there. It is alleged that the complainant was dragged into a washroom and assaulted with a shocker rod and a knife with intent to kill, causing serious injuries including fractures, after which the accused persons fled from the spot.
Learned counsel for the applicant submits that the co-accused, namely Shubham Pandey and Rakesh Kumar Gautam @ Rakesh Gautam, have been granted stay of arrest vide orders dated 06.06.2025 and 14.07.2025 passed in Criminal Misc. Writ Petition Nos. 4975 of 2025 and 6113 of 2025 respectively. Both the said orders have been placed on record as Annexures 15 and 16 to the bail application. It is submitted that the role assigned to the present Versus Counsel for Applicant(s) : Atul Verma, Akhilendra Pratap Singh, Vinod Kumar Yadav Counsel for Opposite Party(s) : G.A. Karan Sonkar .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. .....Opposite Party(s)
applicant is akin to that of the said co-accused who have been granted protection from arrest. It is further submitted that the injured, in his statement recorded under Section 180 BNSS, has made only general allegations against the applicant.
It is also submitted that the applicant has explained the criminal history of five cases in paragraph 34 of the bail application; that out of the said five cases, in four cases no summons have been received by him and in one case he has already been granted bail.
It is further submitted that there is no likelihood of the applicant fleeing from justice or tampering with the prosecution witnesses, and in case he is enlarged on bail, he shall not misuse the liberty of bail.
It is lastly contended that during the course of investigation, CCTV footage was shown to the complainant and he has identified the applicant; however, subsequently an affidavit dated 26.05.2025 was filed on behalf of the complainant stating that the present applicant is not the Karan Sonkar involved in the offence and that some other person bearing the same name was involved.
Learned counsel for the complainant does not dispute the aforesaid fact and categorically submits, on the basis of instructions received, that the applicant is not involved in the present case and that some other Karan Sonkar is the accused.
Learned A.G.A. has opposed the prayer for bail and submits that the injured has sustained twelve injuries, several of which are grievous in nature, and compund comminuted fracture shaft tibia (Right) has been found in the supplementary medical report. I have considered the arguments advanced by learned counsel for the parties as well as perused the record. On due consideration of the facts that the applicant has explained the criminal history of five cases in paragraph 34 of the bail application; that out of the said five cases, in four cases he has not received any BAIL No. 12543 of 2025 2
summons and in one case he has already been granted bail; the statement of the injured; the role assigned to the applicant; the arrest- stay order granted in favour of the co-accused named above; and the fact that the applicant has been in jail since 21.11.2025, and without expressing any opinion on the merits of the case, this Court finds it to be a fit case for enlarging the applicant on bail. Accordingly, the bail application is allowed. Let the applicant Karan Sonkar, involved in the aforesaid FIR/Case crime number, be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial Court. Any other condition(s) which the trial court/concerned court may deem fit and proper, in the circumstances of the case, may also be imposed. It is clarified that the observations made in this order are confined to the present bail application and shall have no bearing on the merits of the trial.
