GP FOR HOME The Court made the following: 2 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the inaction of Respondents 1 to 3 herein in taking any action against Respondents 4 to 9 herein against their illegal activity of proceeding with illegal constructions in the properties as described in the schedule annexed to O.S.No. 85/2012 on the file of the Principal Senior Civil Judge,Anakapalli which is annexed herewith in spite of a permanent injunction decree issued by the said court restraining Respondents 4 to 9 from making constructions in the said property as illegal, arbitrary, unjust and in dereliction of their lawful duties and constitutional obligations and against the constitutional guarantees and to consequently direct the Respondents 1 to 3 to immediately take appropriate severe action against Respondents 4 to 9 from proceeding with any construction activity in the above said properties and to take all necessary actions to see that such construction activity is not carried.” 2. Sri Md.Farooq, learned Assistant Government Pleader for Home, would submit that, the matter is civil in nature and the Police cannot interfere in the civil issues unless there is a direction from the Court. 3. Sri K.Sarvabhouma Rao, learned counsel for the Petitioners would submit that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is disposed of giving liberty to the Petitioners to work out their remedies before appropriate forum in accordance with law.
