HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 7172 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicant, learned AGA and perused the record.
2. The accused-applicant seeks bail in FIR/Case Crime No.0563 of 2024 under Sections 318(4), 316(5), 338, 336(3), 340(2), 61(2), 351(3), 352, 111(2)(b), of B.N.S. and section 3/21(3) BUDS Act, registered at Police Station- Safdarganj, District- Barabanki.
3. In terms of the FIR, allegations were levelled that Multi-State Co- operative Society was formed wherein certain amounts were deposited, however, the same was siphoned off. The applicant is said to be the promoter of the Cooperative Society.
4. It is argued that the co-accused were granted the bail as is evident from the bail orders passed by the trial court itself.
5. Considering the fact that the co-accused with similar allegations have been enlarged on bail and the material to implicate the applicant under section 111 BNS is apparently missing, the applicant who is in custody since 20.06.2025 and has no criminal history is entitled for the bail. Thus the bail application is allowed.
