The respondent no.2 has adjudicated the case by an order dated 28.04.2024 under Section 73 of the Act imposing the tax liability along with interest and penalty amounting to Rs.52,01,440/-. 6. Since the sole Proprietor of the petitioner Firm had expired on 28.04.2021, the Firm ceased to exist and therefore, there was nobody to access the website/ Portal of the Department where notices were published under Section 67 and 73 only under the 'Additional Notices' tab. 7.
A request has been made by the learned Counsel for the petitioner that the Department may be directed to give a personal hearing to the legal representative of the Firm i.e. Suresh Kumar s/o Shiv Dularey Gupta. 8. Learned counsel for the petitioner has also pointed out Form GST DRC -01, filed at page-30 of the paper book, which is a summary of the show cause notice issued to the petitioner under Section 73 of the Act. Learned Standing Counsel appearing on behalf of the State Respondent, on the basis of instructions, says that the proprietorship Firm continued to operate even after the death of the sole Proprietor on 28.04.2021 and his son Suresh Kumar continued to upload returns on the Department's Portal till 11.11.2025, without informing the Department that the original Proprietor had died. 10. Since the Portal was being accessed by the son of the sole Proprietor, he had full notice of the orders passed under Sections 61 and 73 of the WTAX No. 1407 of 2025 2
Act. 11. It has been stated that a Statutory remedy of filing an Appeal under Section 107 is available to the petitioner. 12. This petition is disposed of with a direction to the petitioner to approach the Appellate Authority under Section 107 of the G.S.T. Act. 13. However, we are constrained to observe that repeatedly we are finding such kind of notices to be issued under Section 73 of the Act where law has already been settled by this Court and the Departmental Circular is in place which provides that date, time and place of personal hearing shall be mentioned in the show cause notice. 14.
We direct the Department concerned to send Sri Umashankar Tiwari, Commercial Tax Officer, Ayodhya Sector-4, Ayodhya (B), Ayodhya, U.P., for training for three month. He shall not be assigned any adjudicatory role for the period of three months. December 8, 2025 Rahul WTAX No. 1407 of 2025 3 (Amitabh Kumar Rai,J.) (Mrs. Sangeeta Chandra,J.)
