Rahman, learned counsel appearing for the accused petitioner as well as Mr. P. Borthakur, learned Addl. P.P., Assam appearing for the State respondent. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioner, namely, Arup Deka, praying for grant of bail in connection with Ghograpar P.S. Case No.76/2025 under Sections 20(b)/23(b) of Page No.# 2/2 NDPS Act. 3. The allegations is recovery of intermediate quantity of 10.13 kg of suspected ganja from the possession of the accused petitioner. 4. Case diary has been received. 5. Learned Additional Public Prosecutor on the basis of the case diary submits that investigation has progressed and pending for receipt of FSL report. However, it has revealed implicating material against the present accused. 6. Despite adverse materials, considering the progress of investigation and length of detention, the accused can be allowed to go on bail. 7. Accordingly, it is provided that the accused petitioner, named above, shall be released on bail of Rs.50,000/- each with one suitable surety of like amount each to the satisfaction of learned concerned court subject to the following conditions that the petitioner: (a) shall not abscond. (b) Shall not hamper or tamper with evidence. (c) shall not indulge in any illegal activities including any activities prohibited by the NDPS Act. 8.
