No. - 1362 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. 1.The present anticipatory bail application has been filed seeking anticipatory bail in case crime No.0118 of 2020 under sections 3/5/8 of U.P. Prevention of Cow Slaughter Act, P.S. Safipur, district Unnao. 2.Heard learned counsel for the applicant and Mr. Rajeev Kumar Verma, learned Additional Government Advocate-I for the State. Notice to respondent No.2 is dispensed with in view of the proposed order. 3.Learned counsel for the applicant submits that offences are triable by Magistrate. The applicant has no criminal history. The applicant has been falsely implicated. Charge sheet has been filed. Learned counsel for the applicant undertakes that the applicant shall cooperate in the trial. 4. Learned Addl. Government Advocate has opposed the prayer made by applicant's counsel. He submits that the independent witnesses have seen the incident. Presence of the applicant at the place of the incident and his complicity has been alleged by the independent witnesses. 5.I have considered the submission and perused the record. A perusal of the records shows that there are eye witness account of this case. Three persons have seen the incident. The statement of the complainant has been verified by the independent witnesses which have Versus Counsel for Applicant(s) : Dheerendra Singh Counsel for Opposite Party(s) : G.A. Mohd. Umar @ Sheebu .....Applicant(s) State Of U.P. Thru. Its Addl. Chief Secy. Home Lko. And Another .....Opposite Party(s) been noted by percha No.6 of the investigating officer. The trial court while rejecting the anticipatory bail application has recorded the following observations : "अिभयोजन प्ष का तकर् है िक िदनांक 19.04.2020 की सुबह 8:00 बजे के करीब जब यादी मुकदमा खेतों के तरफ जा रहा था तो उसने देखा िक ्षाम गोटईया व म्टाचारी के बीच िस्थत नाले पर भीड़ खड़ी थी। पंहुच कर देखा तो एक भूरे रंग की गाय का कटा हुआ िसर नाले के िकनारे पड़ा था। उ्व गाय का माथा काला था। मौके पर खून ताजा पड़ा था। के स जायरी के पचार् नं० 06 पर बादी मुकदमा राम िसह ने यह बताया है िक मेरे गांव के ल्डन, शीबू उफर् नो० उमर ने गोकशी की घटना की थी। गांव के रामकु मार, रामे्षर, अशोक व अजय ने घटना को देखा था लेिकन मुलिजमान के डर के कारण इन लोगों ने अब तक िकसी को नहीं बताया। बादी के उ्व कथनों की पुि्ि गवाह रामकु मार, गवाह अशोक, गवाह अजय, गवाह रजनेश ने के स डायरी के पचार् नं0 06 पर अंिकत अपने बयानों में की है। बाद िववेचना पुिलस ्षारा वतर्मान अिभयु्वगण के िवरु्ध आरोप-प्ऴ ्ऺेिषत िकया जा चुका है। अिभयु्वगण ्षारा कािरत अपराध अत्यन्त गंभीर ्ऺकृ ित का है। मामले के तथ्य एवं पिरिस्थितयों में अिभयु्व को अि्षम जमानत पर छोडे जाने का आधार पयार्प्त नहीं है। तद्नुसार अि्षम जमानत ्ऺाथर्ना प्ऴ िनरस्त िकये जाने योग्य है।" 6.On due consideration to the submission advanced as also the statement of the independent witnesses, it cannot be said that it is a case of false implication or the applicant has been implicated only to injure his reputation.
