The case of the prosecution in nutshe" is that thl's I'S a case of kjdnappjng, wrongful confinement, extortion, causI-ng hurt, and crI|minal intimidation, criminal conspiracy with common intention that occurred on 28.03.2025 at approximately 4.00 p.m., at FIat No.501, 5th Floor, jn T.N.Palem, Tirupatj Town and District and reported I-n the police on 29.03.2025 at 05.45 PM by the vl-ctim, Kasaram Rajesh stating that Accused No.1 is his childhood friend and a resl-dent of parvathi Nagar, Jeeva Kona, Tjrupati, invited hI-m tO dI'SCuSS about an I-nSurance poII'Cy. Trusting his intentions, the de-facto complal-nant went {o there I-n hI-S Car, accompanl-ed by his 51 years old mother vijayalakshmi, his 8 years old daughter Mokshith and hl-s 6 months old daughter Jasmitha. upon their arrival, other Accused Nos.2 and 3 and some others were present at the flat. The accused wrongfully confined them and threatened them with dire consequences. subsequently, the accused used the de-facto comp[alnantJs phone to ca" hls wife, / .---,---_3, I \fet- __ _ sumathi, aged 32 years, to the location. Upon her arrival, the accused demanded Rs.2 crores for their release. At midnight, the de-facto complainant was separated from his family and was immediately demanded for Rs.50 lakhs. Agreeing to deliver the amount in Chittoor, the Accused No.2 took him in a black Thar veh-lcle. However, on enroute, near lthepalli village on Tirupati-Chittoor road, the Accused No.2 assaulted the complainant with a rod, inflicting injuries on his head and hand. The de-facto complainant raised loud cries, which attracted the attention of the public. Then the accused left him and fled away from the place. The de-facto complainant Successfully escaped from their clutches and was later admitted to SVRR GG Hospital, Tirupati for treatment. During investigation, the Accused Nos.1 to 6 were arrested on 05.04.2025 and sent them for remand. 3. Heard learned counsel for the Petitioner/Accused No.6 and the learned Assistant Public Prosecutor. Perused the record. -,--` r, t -= t ~S 4. Sri Murali Mohan Bathala, the learned counsel for the petitioner/Accused No.6 submits that the petitioner/Accused No.6 has not committed any offence; petitioner/Accused No.6 was falsely implicated by the police in the crime; petitioner/Accused No.6 is the sole breadwinner; petitioner/Accused No.6 would abide by any conditions to be imposed by this Court; and urged to allow the petition. 5. Per confra, Ms. P. Akila Naidu, the learned Assistant Public Prosecutor, opposed in granting of bail stating that some more material wl-tnesses have to be examined; investigation is not completed; if the petitioner/Accused No.6 I-s enlarged on bail, he would not be available for the investigation and he would escape from the clutches of law; and urged to dismiss the bail petition. 6. As seen from the record, the petitioner/Accused No.6 has been in the judicial custody for the past 54 days. The Petitioner/Accused No.6 is resident of Chillakuru H.W.Village, Pellakur Mandal, Tirupati District of Andhra Pradesh. If the petitioner/Accused No.6 is enlarged on bail with stringent conditions, he would not flee away from the clutches of the law, and interest of the justice would be served. 7. Keeping in v-lew of the period of detention undergone by the petitioner/Accused No.6 in judicial custody for more than 54 days, the nature and gravity of allegation levelled against the petitioner/Accused No.6, and his alleged role in the case, this Court is inclined to enlarge the petitioner/Accused No.6 on bail with the following stringent conditions. 8. in the result, the criminal petition is allowed with the following conditions: i. The petitioner/Accused No.6 shall be enlarged on bail subject to executing a bond for a sum of Rs.20,000/- (Rupees twenty thousand only), with two sureties each for the like sum to the satisfaction of the learned [V Additional Judicial Magistrate of First Class, Tirupati. ii.
