Nasruddin 3.Shahina Yasmin @ Shabina Yasmin, W/o Aslam Khan All R/o Village- Unchari, P.O. & P.S.- Garhwa, District- Garhwa (Jharkhand) .... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s). ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Syed Tafazzul Sajid, Advocate For the State : Mr. Sudhir Kumar Mahto, AddI. P.P. …...... 02/ 15.07.2025: Heard, learned counsel for the petitioners and learned counsel for the State. 2. This is an application filed by the petitioners praying for grant of anticipatory bail in terms of under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, has been preferred by the petitioners apprehending their arrest for offences under Sections 126(2), 115(2), 118(1), 117(2), 109, 3(5) of B.N.S. 3. There is allegation that these petitioners have assaulted the informant’s husband and injured him seriously. There is allegation that with sharp cutting weapon, the assault was made. Further it is stated that the pregnant daughter-in-law of the informant was also assaulted. Thus, I find that this is not a fit case for grant of anticipatory bail to the petitioners. 4. Considering the nature of allegation, I am not inclined to entertain the anticipatory bail application. Accordingly, the prayer for anticipatory bail of the petitioners in connection with Garhwa P.S. Case No.613 of 2024, pending in the Court of learned C.J.M., Garhwa, stands rejected. 5. Petitioners should appear before the concerned Court and on their appearance the Court concerned shall pass order considering the individual overt act, further, the Court will also consider whether the Sections invoked in the F.I.R. can be applied to each of the petitioners or not. Thereafter, pass an appropriate order without being prejudiced by the order of this Court. (ANANDA SEN, J.) R.S./
