Also heard Mr. B. Sarma, the learned Additional Public Prosecutor appearing for the State of Assam. 2. This application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the petitioners, namely, 1. Ajoy Singha, and 2. Sandhya Rani Devi, praying for quashing of the proceedings of PRC Case No. 124/2023 under Sections 366/376 of the Indian Penal Code, 1860 against petitioner No. 1 and 366/34 of the Indian Penal Code, 1860 against petitioner No. 2. 3. The learned counsel for the petitioners has submitted that though the petitioners are not pressing for their original prayer made in this criminal petition and instead they are willing and ready to face the trial. However, he is apprehensive that as both the petitioners are shown as absconder in the charge sheet, they may not be granted bail. 4. As the petitioners are not pressing for their original prayer made in this criminal petition, and as they are ready to appear before the Trial Court and face the trial, this criminal petition is disposed of with a direction to both the petitioners to appear before the Trial Court on the next date fixed, i.e. 25.09.2025. 5. On their appearance before the Trial Court, the petitioners may Page No.# 3/3 seek any relief, to which they are legally entitled to. 6.
