Kotapadu Police Station, now Anakapalli District, registered for the offences under Sections 20(b)(ii)(B) I/w 8(c) of NDPS Act. 2. Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent. 3. The case of the prosecution is that on receipt of information that the petitioners have been possessing and transporting contraband (Ganja) of + s=z=-` `` === _t -+ 2 KM,I Crl.P.No.5694 of 2O-I.5 /. 12 kg have conducted a raid on 24.03.2025 and seized 6 kg of contraband from each of the petitioners and the petitioners were remanded to judicial custody on 24.03.2025. 4. The contention of the petitioners is that since 24.03.2025, they have been languishing in jail and that they have nothing to do with the contraband seized. The petitioners were falsely implicated in the crime. lt iS further argued that the quantity of the contraband seized in all is 12 kg which is below the commercial quantity. The same has not been disputed by the learned Public Prosecutor. 5. Having regard to the same, this Court deems it appropriate JtO allow the application subject to the following conditions:- (i) The petitioners/accused Nos.1 & 2 shall be enlarged on bail on executing personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties for like Sum each tO the satisfaction of the learned Additional Judicial First Class Magistrate, Chodavaram. (ii) The petitioners shall mark their attendance before the investigating officer on lSt week of every month between 10.00 AM to 05.00 PM till filing of the charge sheet. (iii) The petitioners shall make themselves available for investigation aS and when required and they shall not, directly or indirectly, make any inducement, threat or promise to any persons acquainted with the facts ``-~-_ jb rI 3 KM,J CrI.P.No.5694 of 2O25 of the case to dissuade them from disclosing such facts to the Court or to any police officer. (iv) The petitioners shall not indulge in similar acts of crime. (v) The petitioners must regularly participate in the pre-trial and trial process without fail before the competent Court. 6.
