Smt. Nirmla Devi & Ors. VS. State of Himachal Pradesh & Ors. CWP No. 8949 of 2024 11.08.2025 Present: Mr. Naresh Kaul & Ms. Sheetal Kaul, Advocates, for the petitioner. Mr. Anup Rattan, Advocate General, Mr. Rajan Kahol & Mr. B.C. Verma, Additional Advocate Generals, for the non-applicant-respondents-State. While placing on record communication dated 07.08.2025, issued under the signatures of Director, School Education, Himachal Pradesh, which is taken on record, Mr. Rajan Kahol, learned Additional Advocate General, states that mandate contained in the judgment, in question stands complied with in respect of 17 petitioners, whereas benefit, in respect of one petitioner, namely Smt. Sarestha Devi, could not be granted, because her revised pension case along with service book has been sent to the office of Accountant General for taking necessary action. Having perused aforesaid communication as well as documents annexed therewith, this Court finds that Deputy Director, Kangra at Dharamshala has informed Director, School Education, Himachal Pradesh that 17 petitioners have been granted the benefit of promotional increment on the post of HT w.e.f 01.10.2012 on the analogy of CWP No. 2500 of 2021, titled as Ranjit Singh & Ors. Vs. State of H.P, and as such, nothing remains to be adjudicated qua 17 petitioners. So far as the petitioner, namely Smt. Sarestha Devi, is concerned, her claim with regard to benefit of HT promotion increment w.e.f 01.10.2012 shall only be considered and decided after the receipt of revised pension case along with her service book from the office of Accountant General as has been fairly stated by Mr. Rajan Kahol, learned Additional Advocate General. In view of the above, nothing remains to be adjudicated in the instant proceedings and accordingly, the same are disposed of with a direction to the respondents to ensure that benefit, in terms of mandate contained in the judgment, sought to be complied with, is also extended to Smt. Sarestha Devi expeditiously, preferably within four weeks. Pending application(s), if any, stand disposed of. August 11, 2025 (Sandeep Sharma), (sunil) Judge
