2. This is an application under Section 482 of the BNSS, 2023, praying for grant of bail to the accused/petitioner, who has been arrested in connection with Dhekiajuli P.S. Case No. 163/2025, under Sections 315(5)/318/314/3(5) of BNS.
3. The case diary as called for is received and I have perused.
4. It is submitted by Mr. P. Borthakur, learned Addl.P.P. that there are sufficient incriminating materials against the present petitioner and he is stated to be one of the two prime accused in the alleged offence.
5. The allegation in the FIR in a gist pertains to replacing the gold deposits of the customers with fake gold and misappropriating the gold and selling illegally.
6. The present petitioner was stated to be an in-Charge of the branch of the company where the alleged offence had taken place.
7. The learned Addl. P.P. submits that investigation is not yet completed and one undertaken so far has found implicating materials linking the present petitioner with the offences and lending support to the allegation of the FIR.
8. It is submitted that custodial interrogation of the present petitioner might be necessary considering the situation.
9. Upon considering the matter, I find force in the contention of the prosecution and I agree that it may not be prudent to grant anticipatory bail to the present petitioner, at this stage.
10. Accordingly, this anticipatory bail application stands disposed of.
