Sarania, the learned counsel on behalf of Mr. A. Sarma for the respondent No. 4 as well as Mr. T.R. Gogoi, the learned counsel for the respondent Nos. 2 and 3. 2. This application under Order 22 Rule 4 of the Code of Civil Procedure, 1908 has been filed by the applicants praying for substitution of the legal heirs of the respondent No. 1, namely, Ramji Shah, who expired on 05.02.2022. Page No.# 3/3 Though the appeal was abated on his death, however, the abatement has been set aside by this Court, by order dated 16.10.2025, passed in I.A.(Civil) No. 4083/2024. 3. The applicant has prayed for substituting the names of Laba Kumar Shah and Ashok Kumar Shah, who are the sons of deceased respondent late Ramji Shah. 4. The said prayer is not opposed to by the respondent’s side. 5. Hence, the same is allowed. 6. The names of Laba Kumar Shah and Ashok Kumar Shah shall be substituted as respondent No. 1(a) and 1(b) in place of deceased respondent Ramji Kumar Shah. 7. The applicant shall submit an amended memo of appeal showing the names of the substituted defendant therein. 8. Registry is directed to list the connected appeal after 2(two) weeks.
