CMP No. 23763 of 2025 By way of this application, a prayer has been made by respondent No.4 for recalling of order dated 23.04.2025, in terms whereof, the said respondent was proceeded against exparte. Learned counsel for the applicant apprises the Court that the reason as to why learned counsel could not appear on behalf of respondent No.4 was that despite power of attorney having been filed, his name was not reflected in the cause list. He submits that as the non-appearance was not intentional, this application be allowed by recalling order dated 23.04.2025. In light of the averments made in the application, the same is allowed.
