Both the appellants are present through V.C. whereas counsel for the respondent- Insurance Company is present in person, duly identified by their respective counsels. 5. This Appeal from Order under Section 173 of the Motor Vehicles Act has been filed by the appellants challenging the impugned order dated 22.01.2013, passed by learned Motor Accident Claims Tribunal /Additional District Judge, Kashipur, District Udham Singh Nagar, in Motor Accident Claim Petition No. 57 of 2011, Jogender Singh & others vs. Aslam Hafi @ Aslam Hussain & others, partly allowing the Claim Petition to the extent of payment of Rs.2,64,000/- as compensation along with 6% interest against the Claim of Rs.10,00,000/- as claimed by the appellants. 6. Today, the parties have filed a Compromise Application, wherein both the parties have entered into compromise on 2025:UHC:3860 the following terms: “Parties have come to a compromise that the claimants/appellants will get a lump sum amount of Rs. 1,10,000/- (One Lakh Ten Thousands) in addition to the amount paid already. This amount will be paid without any interest to the claimants/appellants within a period of 8 weeks from the date of issuance of the certified copy of the order. This amount will be paid by New India Assurance Company i.e. respondent no.3.” The settlement-deed shall form part of record. 7.
