Criminal Miscellaneous Bail Application No. 6700/2025 Mahaveer S/o Shri Kesar Singh, Aged About 36 Years, R/o Chando Ka Badiya, Gopalsagar, Police Station Beawar Sadar, District Beawar. (At Present In Judicial Custody In Central Jail, Ajmer Since 6.5.2025). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Yunush Khan for Mr. Kishan Lal Sharma For Respondent(s) : Mr. R.S. Shekhawat, AGA HON'BLE MR. JUSTICE MANEESH SHARMA (V. J.) Order 16/06/2025 1. The instant bail application has been filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 on behalf of the petitioner, who has been arrested in connection with FIR No.80/2025 registered at Police Station Mangaliawas, District Ajmer for the offence punishable under Sections 8/ 15 of NDPS Act, 1985. 2. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case and alleged recovered contraband is below commercial quantity; charge-sheet has already been filed and petitioner is in custody since 06.05.2025; the trial of the case will take considerable time, therefore, further custody of the petitioner would not serve any fruitful purpose and petitioner be released on bail. [2025:RJ-JP:23274] (2 of 3) [CRLMB-6700/2025] 3. Learned Additional Government Advocate has opposed the submissions made by the learned counsel for the petitioner. 4. Heard learned counsel for both the parties and perused the material available on record. 5. Having regard to the totality of the facts and circumstances of the case, considering the arguments so advanced by the learned counsel for the petitioner, as also the fact that the alleged recovered contraband is below commercial quantity; charge-sheet has already been filed, considering the fact that petitioner is in custody since 06.05.2025 and trial/investigation of the case may take considerable time, thus, without commenting any opinion on the merits/demerits of the case, I deem it just and proper to allow this bail application. 6. Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioner Mahaveer S/o Shri Kesar Singh shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned Trial Court for their appearance before the court concerned on all the dates of hearing as and when called upon to do so. 7. It is made clear that the petitioner shall not involve in any offence(s) of similar nature during currency of the bail and he shall mark his presence in the first week of every two months in concerned policy station till trial is concluded. [2025:RJ-JP:23274] (3 of 3) [CRLMB-6700/2025] 8. If any breach of these considerations is reported or come to the notice of the Court, the same shall alone be a reason for the trial Court to cancel the bail granted to him by this Court. 9. Concerned SHO is directed to maintain a register recording the attendance of the petitioner. In case the petitioner fails to mark their presence in the concerned police station, the concerned SHO is directed to immediately report the matter to the concerned Court in this regard.
