Heard learned counsel for the petitioner and the learned Assistant Public Prosecutor representing the respondenVState. 3. Case of the prosecution, in brief, is that, the husband of the complainant expired within 14 months of their-marriage. Due to their conjugal life a baby was born to them. Since the death of the husband of the complainant, the accused who is her brothers friend used to came to her house frequently and developed friendship and it lead to coexistence in between them and enjoyed her physically on the rf a igr-rf> promise of marriage. When the complainan{ asked the petitioner to marry, he refused. Basing on the complaint of the complainant, the crime was registered and investigated into. 4. Heard learned counsel for the petitioner and learned Assistant Public Prosecutor. Perused the record. 5. Learned counsel for the petitioner submit that even as per the allegations in the complaint, the provisions under Section 69 of B.N.S cannot be made available. The defacto complainant and the petitioner were in consensual relationship for the last five years and the defacto comp]ai-rlant is six years elder to the petitioner. Police have recorded the statement of seven witnesses and nothing could be elicited to attract the provions under Section 69 B.N.S and prays to grant anticipatory bail to the petitioner. 6. A perusal of the material available on record goes to show that the crime was registered on 12.3.2025. lt is submitted by the learned counsel for the petitioner that seven witnesses were examined and there are no specific allegations against the accused. Considering the said fact, this Court is inclined to grant anticipatory bail to the petitioner. 7. Accordingly, the petitioner/accused is directed to surrender before the Station House Officer, Jaggampeta Police Station, Kakinada District within a period of two (o2) weeks from the date of receipt of a copy of the order and on his surrender, the petitioner shall be released on ba" on his executing a personal bond for a sum of Rs.10,000/- (Rupees ten thousand Only) With two Sureties for a like Sum each tO the satisfaction of the arresting police officials and the petitioner shall make himself available for investigation as and when required and he sha" not cause any threat] inducement or promise to the prosecution witnesses. 8.
