HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 5462 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard learned counsel for the applicant as well as learned AGA for the State. None appears on behalf of the complainant, although, as per the instructions of learned AGA, notice to the complainant is served. According to the prosecution case, it is alleged that on 07.05.2025, while the informant was returning from Barabanki, at around 3:00 p.m., the accused attempted to hand over a mobile phone to the informant’s minor daughter, aged about 14 years. When he was stopped, the accused allegedly caught hold of the girl’s hand and dragged her. Upon objection being raised, he abused the informant and left the spot. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that material improvements have been made in the prosecution version, and in the victim’s statement recorded under Section 180 of the BNS, the narrative differs from that of the FIR. There is no corroborative evidence against the applicant. The charge sheet has already been filed. The applicant has been in custody since 08.05.2025, and the alleged offences are punishable with a maximum sentence of seven years. It is further submitted that there is no possibility of the applicant of fleeing away after being released from jail or tampering with the witnesses.
