Verma, Additional Advocate Generals with Mr. Ravi Chauhan, Deputy Advocate General. _______________________________________________________ Sandeep Sharma, Judge(oral): Careful perusal of reply filed on behalf of respondents No. 1 to 3 under the signatures of Chief Conservator of Forests, Chamba, Forest Circle, Chamba, Himachal Pradesh, reveals that pursuant to mandate contained in the judgment, sought to be executed, petitioner herein has been granted work charge status on completion of eight years daily wage service w.e.f 01.09.2001 vide Divisional Forest Officer, Pangi, O/o No. 06/2025–26 dated 11.04.2025. 2. Mr. D.K.Khanna, learned counsel for the petitioner, while fairly acknowledging factum with regard to conferment of work charge 1 Whether the reporters of the local papers may be allowed to see the judgment? 2 status from the date detailed hereinabove, states that till date neither arrears have been paid nor petitioner has been assigned seniority. 3. Having carefully perused order dated 06.02.2025 passed by Hon’ble Apex Court in Civil Appeal No. 1595 of 2025, titled as State of Himachal Pradesh and others vs. Surajmani and others, this Court is persuaded to agree with Mr. B.C.Verma, learned Additional Advocate General, that benefits, if any, on account of conferment of work charge status are to be granted on notional basis, whereas other benefits like seniority and pay fixation shall be given from the due date. 4. In view of the above, this Court is of the view that nothing remains to be adjudicated in the instant petition and accordingly, the same is disposed with a direction to the respondents to ensure that service benefits other than arrears, if not already granted, may be granted to the petitioner on account of his having conferred work charge status w.e.f 01.09.2001. Liberty is reserved to the petitioner to file appropriate proceedings in appropriate Court of law qua the surviving grievance. (Sandeep Sharma), Judge June 25, 2025 (sunil)
