This writ petition has been filed challenging the order dated 28.08.2017 passed by respondent no.3, Executive Engineer, Nalkoop Khand, Amethi, whereby it has been held that the regularization of the petitioner on the post of Tube-well Operator w.e.f. 01.09.1997 was not in accordance with law, and it should have been regularized w.e.f. 14.02.2002. The contention of the petitioner is that the order dated 28.08.2017 has been passed without affording any opportunity of hearing to the petitioner and behind the back of the petitioner, whereas similarly situated juniors have been treated differently. Accordingly, the writ petition is disposed of with a direction to respondent no.2, Superintending Engineer, Nalkoop Khand, Faizabad Division, Faizabad, to pass a fresh order after giving an opportunity of hearing to the petitioner with respect to his right of regularization on the post of Tube-well Operator, within a period of two months from the date a certified copy of this order is produced before him. The order dated 28.08.2017 shall abide by the decision to be taken as directed hereinabove.
