The applicant has filed this application under Section 482, Cr.P.C. with the following main prayers: For the facts, reasons and circumstances stated in the accompanying affidavit, in support of this petition, it is most respectfully prayed that this Hon'ble court may kindly be pleased to quash the impugned order dated 16.11.2022 passed by the Additional Chief Judicial Magistrate-III, Court No.27, Lucknow in Complaint Case No.3179 /2021; Police Station Mohanlalganja, Lucknow: Smt. Dhandei Versus Jaikaran and others whereby the petitioner have been summoned for the offence under section 323,504,506 I.P.C. as well as Order dated 25.10.2024 including further proceeding in pursuant thereto to the extent it relates to the petitioner. It is further most respectfully prayed that during pendency of the instant petition, operation and implementation of the impugned order dated order dated 16.11.2022, passed by the Additional Chief Judicial Magistrate-III, Court No.27, Lucknow in Complaint Case No.3179/2021; Police Station Mohanlalganja, Lucknow: Smt. Dhandei Versus Jaikaran and others as well as order dated 25.10.2024 including further proceeding in pursuant thereto to the extent it relates to the Versus Counsel for Applicant(s) : Anumesh Mishra Counsel for Opposite Party(s) : G.A. Bhola Prasad @ Bhola .....Applicant(s) State Of U.P. Thru. Addl. Chief Secy. Deptt. Of Home Lko. And Another .....Opposite Party(s) petitioner, may kindly be stayed pending disposal of instant petition in the interest of justice. After arguing at some length, learned counsel for the applicant submits that he does not want to press the application on merit, however, he submits that the applicant could not appear before the court below for the reason that he was not given information by his counsel and order dated 25.10.2024 for issuing the Non Bailable Warrant against the applicant has been passed. Learned A.G.A. has no objection to the limited prayer made by the counsel for the applicant. The applicant will move application for recall of order within 2 weeks from today and the court below will take decision thereon within 4 weeks thereafter. For a period of 6 weeks from today, operation of the impugned orders, herein, shall remain stayed. With the above observations/directions, this application is disposed of.
