GP FOR ROADS BUILDINGS (AP) The Court made the following: 2 ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- “….to issue a writ, order or direction more particularly one in the nature of writ of mandamus to declare the resolution No.47 of agenda dated 25.11.2014 in General body meeting of the 2nd respondent Municipality as illegal, null void and without jurisdiction and consequentially direct the respondent not to grant any construction of Arch across the road in Alapati Nagar, Tenali Town, Guntur District....” 2. When the matter came up for admission on 28.01.2015, this Court passed the following interim order: “….The case of the petitioners is that though the Government passed orders earlier not to construct any Arches, the Tenali Municipality-2nd respondent passed resolution for obtaining permission from the Government for construction of Arch in Road No.3 of Alapati Nagar, Tenali Town, Guntur District. Further, it is submitted that though the 1st respondent has not granted any permission, attempt is being made for construction of the Arch. Aggrieved by the same, the present writ petition is filed. Heard the learned counsel for the petitioners. Learned counsel for the 2nd respondent states that no construction of the Arch is being allowed since the Government has not granted permission. In view of the above facts and circumstances, there shall be interim stay of construction of Arch in Road No.3 of Alapati Nagar, Tenali Town, Guntur District until further orders.” 3. Today, when the matter came up for hearing, learned Standing Counsel representing respondent No.2, on oral instructions, has informed this Court that in pursuance of the interim order dated 28.01.2015 granted by this Court, 3 no Arch was constructed in Road No.3 of Alapati Nagar, Tenali Town, Guntur District. 4. Recording the same, the Writ Petition is closed. There shall be no order as to costs.
